Terms of Service

These Terms of Service ("Terms") govern your access to and use of the SmartZman mobile application and related services (the "Service"), operated by SmartZman Systems LLC ("SmartZman," "we," "our," or "us"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. The Service

SmartZman provides scheduling and automation tools that allow users to create automated actions for supported smart home devices, with schedules based on halachic zmanim. SmartZman does not manufacture devices and does not control third-party hardware or services.

2. Account Registration

You must create an account to use SmartZman. You are responsible for maintaining the security of your account credentials and must provide accurate information and keep it up to date.

3. Subscription and Payment

SmartZman is available through a paid subscription. Pricing is displayed in the app at the time of purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Refunds are handled in accordance with the policies of the App Store or Google Play, depending on your platform.

4. Acceptable Use & Fair Usage

SmartZman is intended for normal residential and personal smart home automation use. You agree not to:

• Reverse-engineer, decompile, or attempt to extract the source code of the app.
• Use the Service to control devices in a manner that violates any law or regulation.
• Attempt to gain unauthorized access to other users' accounts or data.
• Use automated scripts, bots, or other tools to scrape, overload, or manipulate the Service beyond its intended design.
• Use the Service for unauthorized commercial, industrial, or high-risk purposes.

We reserve the right to monitor usage patterns to ensure fair and reasonable use. If usage is determined to be excessive, abusive, or harmful to system stability, we may suspend or limit access, restrict features, or terminate your account — with or without prior notice where necessary to protect the Service.

5. User Responsibilities

You are responsible for properly configuring schedules, verifying their accuracy, maintaining safe device settings, ensuring reliable internet connectivity, and maintaining your connected smart devices. You acknowledge that automated device control may carry inherent risks if improperly configured.

6. No Guarantee of Uninterrupted Service

The Service is provided on an "as is" and "as available" basis. SmartZman does not guarantee continuous or uninterrupted operation, error-free execution of schedules, timely delivery of automated commands, or compatibility with all devices or integrations. Scheduled actions may fail or be delayed due to factors outside our control, including internet outages, device malfunctions, third-party service interruptions, API changes, power failures, or software errors.

7. Third-Party Integrations

SmartZman integrates with third-party smart home services and devices. We are not responsible for the availability or reliability of third-party services, changes to third-party APIs, device behavior or malfunctions, or actions taken by third-party providers. Your use of third-party services is subject to their respective terms and policies.

8. Safety & Automation Risk

You are solely responsible for ensuring that your device configurations are safe and appropriate for your environment. SmartZman is not responsible for incorrect or unintended device activation, missed or delayed schedules, device failures, property damage, personal injury, or any indirect or consequential damages arising from use of the Service. The Service is not intended for life-safety, medical, emergency, or critical systems.

9. Zmanim Accuracy

Zmanim calculations are based on your configured location and established astronomical algorithms. While we strive for accuracy, minor variations may exist compared to other zmanim sources. For matters of halachic obligation, consult your posek.

10. Intellectual Property

The SmartZman app, its design, code, and branding are the intellectual property of SmartZman Systems LLC. Your subscription grants you a personal, non-transferable license to use the app.

11. Limitation of Liability

To the maximum extent permitted by law, SmartZman Systems LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of property, loss of data, business interruption, or personal injury arising from your use of the Service. In no event shall SmartZman's total liability exceed the amount paid by you for the Service during the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless SmartZman Systems LLC, its owners, officers, and affiliates from any claims, damages, liabilities, or expenses arising from your use of the Service, your device configurations, your violation of these Terms, or any harm caused by your automated device schedules.

13. Beta Features

Some features may be released as beta or experimental. Beta features may be modified, suspended, or discontinued at any time without notice.

14. Termination

You may cancel your subscription and delete your account at any time through the app. We may suspend or terminate your account if you violate these Terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.

15. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of New York, without regard to conflict of law principles.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the app or on our website. Continued use after changes constitutes acceptance.
